What you get, what you owe, and what we do not promise.
Short sentences and no traps. The section that matters most is the one that says you are the publisher.
Effective 31 August 2026
01The agreement
These terms are the agreement between you and Interactive.RealEstate. By enrolling, signing in, or using any tool, you accept them. If you are enrolling on behalf of a brokerage or team, you are confirming you have the authority to accept them for that organization.
02Who may use the platform
You must be at least 18 and, for the tools that produce real estate advertising, hold an active license or work under a broker who does. You are responsible for keeping your license and brokerage details in your profile accurate, because the platform prints them on the material it generates.
One seat is one person. Seats are not shared, and passwords are not to be handed around a team — office managers can add seats instead.
03Your subscription
Plans are billed in advance for the period you choose and renew automatically until you cancel. Each plan includes a stated amount of tool usage for the period. Usage does not roll over.
Cancel any time from your account. Cancellation stops the next renewal; it does not refund the period you are in. If we materially reduce what a plan includes, we will tell you before the change takes effect and you may cancel without penalty.
Prices can change. We will give at least 30 days' notice before a change applies to an existing subscription.
If a payment fails, we will retry and email you. Access may be suspended while an account is past due. Suspension does not delete your files.
04Payment
Payments are processed by a PCI-compliant payment provider. We never store your full card number, expiration date, or security code — see the Privacy Policy for exactly what is kept.
You are responsible for any taxes that apply to your purchase.
05Who owns what
You own what you put in: your listings, brand assets, logos, headshots, photos, and text. You grant us the licence we need to host that material and run it through the tools you asked for — no broader use than that.
You own what comes out. Assets the platform generates for you are yours to publish, adapt, and use commercially, for as long as your account is in good standing and afterwards.
We own the platform itself — the software, the prompt library, the interface, and the brand. Nothing here transfers any of that to you.
Generative models can produce similar output for different customers from similar inputs. We do not warrant that any generated asset is unique, and you should not treat one as inherently protectable.
06You are the publisher
This is the most important paragraph on the page. Everything the platform produces is a draft prepared for you. You decide whether to publish it, and once you do, you are the advertiser.
Before publishing, confirm the facts are right, that your brokerage's rules and your state's advertising requirements are met, that any required disclosures and license numbers appear, and that you have the rights to the photos and music used.
The compliance screener checks generated content for Fair Housing language, unsupportable claims, manufactured urgency, and risky financial framing, and it blocks output when it finds a serious problem. It is a safety net written by engineers, not legal review, and it will miss things. It does not make us your broker, your compliance officer, or your attorney.
07Listing and MLS data
When you run a tool against an MLS listing, you are asserting that you have the right to market that listing and to use its data and photos for that purpose. MLS rules, IDX terms, and photographer licences continue to apply to anything the platform produces from that data. If your MLS or your broker restricts a use, that restriction wins.
08Estimates and financial figures
Where the platform shows a mortgage payment, an insurance or rent estimate, or an investment projection, it shows the assumptions used alongside it. Those figures are estimates built from third-party data. They are not quotes, guarantees, appraisals, or advice, and they must not be presented to a client as though they were.
09Acceptable use
Do not use the platform to do any of the following.
- Produce advertising that discriminates against, or steers people away from, any class protected by the Fair Housing Act or state law.
- Make claims you cannot support — guaranteed sale prices, guaranteed timelines, invented statistics, or fabricated market authority.
- Fabricate testimonials, reviews, scarcity, or urgency.
- Market property you are not authorized to market, or impersonate another agent, brokerage, or person.
- Upload material you do not have the rights to, or anything unlawful.
- Attempt to break, overload, scrape, or reverse-engineer the platform, or to reach data belonging to another account.
- Resell or white-label platform access without a written agreement with us.
10Availability and support
We aim to keep the service running and will give notice of planned maintenance where we can, but we do not promise uninterrupted availability. Third-party dependencies — the MLS feed, storage, and the AI providers — can and do fail, and a failed run does not consume your usage.
11Your files and retention
Generated assets are filed in Dropbox folders tied to your account, and you can download them at any time. Some categories are removed on a schedule described in the Privacy Policy — history after 60 days, inspiration folders after 100 days, and so on. Download anything you want to keep permanently.
If you close your account, you can export your data first. After closure we delete your content on the schedule in the Privacy Policy.
12Suspension and termination
You can cancel at any time. We may suspend or close an account for non-payment, for a breach of the acceptable use rules above, or where continuing would expose us or another customer to legal risk. Where the situation allows it, we will warn you first and give you a chance to fix it.
13No guarantee of results
We do not promise leads, listings, appointments, or income. Marketing results depend on your market, your effort, and your follow-through. Any figures we publish about the industry are cited to their source and describe other people's results, not a forecast of yours.
14Warranties and liability
The platform is provided as-is and as-available, without warranties beyond those the law will not let us disclaim. To the extent the law allows, we are not liable for indirect, incidental, or consequential damages, or for lost profits or lost business, and our total liability for any claim is limited to the amount you paid us in the twelve months before it arose.
Nothing here limits liability for fraud, or for anything else that cannot lawfully be limited.
15Indemnity
You will cover us against claims arising from material you publish, from your use of listing data or photos, and from your breach of these terms — because those are the parts of the chain only you control.
16Changes, law, and contact
We may update these terms. Material changes will be emailed to account holders at least 30 days before they take effect, and continuing to use the platform after that is acceptance. The governing law and venue will be stated here before the platform accepts paying customers.
